Understand what can transfer
The existing note rate, remaining balance, term and mortgage obligations may be part of an approved assumption. The servicer or holder must authorize the transfer as required. The seller should confirm the approved release of liability instead of assuming deed transfer removes the original borrower's exposure.
- Contact the servicer for current assumption procedures
- Check remaining term and estimated payment including escrow
- Verify release of liability in writing
Plan for the equity difference
If a house is priced higher than the outstanding loan balance, the buyer generally must cover the difference through available funds or an acceptable financing arrangement. A second lien, if permitted, has its own underwriting and combined-payment implications.
- Calculate purchase price minus assumed balance
- Document cash, gift funds or permitted secondary financing
- Compare all-in payment with a new loan
Protect a VA seller's entitlement
If an eligible veteran assumes another veteran's loan and entitlement is properly substituted, the selling veteran may be able to restore that entitlement. If substitution does not occur, the original borrower's entitlement may remain tied to the loan. These consequences should be understood before closing.
